MAGICAL MOMENTS VACATIONS – TERMS & CONDITIONS
By submitting a reservation request, paying a deposit, or confirming a booking with Magical Moments Vacations (“MMV”), you agree to the Terms & Conditions below. Please read carefully, as these govern your booking and your relationship with MMV.
1. Use of Our Services
MMV provides travel planning and booking services for personal, non-commercial use only.
By booking, you confirm that:
You are at least 18 years old and legally able to enter contracts.
All information you provide is accurate and complete.
If booking for others, you have their permission and accept full responsibility for the reservation.
All reservations made by an MMV agent remain the property of MMV until travel is completed and cannot be transferred to another agency or agent.
2. Our Role
MMV is an independent booking agent. We do not own, operate, or control the travel services you purchase. All travel components are provided by third-party suppliers (airlines, hotels, cruise lines, tour operators, etc.) whose terms and conditions apply.
MMV is not responsible for supplier errors, delays, schedule changes, negligence, or failure to provide services.
3. Payments & Pricing
Payment schedules are listed on your invoice/contract.
Prices and availability are not guaranteed until your deposit is received.
Some reservations require full payment at booking.
Checks/money orders incur a $50 processing fee. No fee applies to credit card or gift card payments.
Failure to pay on time may result in cancellation and applicable fees.
You are responsible for reviewing all reservation details for accuracy, including traveler names (must match government ID/passport), dates of birth, travel dates, and itinerary components.
Post-Purchase Price Increases
Suppliers and governments may impose additional charges after booking (taxes, fuel surcharges, exchange rate changes). You authorize MMV to apply and charge such increases after notification.
4. Credit Cards & Chargebacks
If a supplier fails to deliver services, your remedy is directly with the supplier—not MMV.
You agree not to file chargebacks against MMV for supplier failure.
Should MMV incur costs to reverse a chargeback, you agree to reimburse all related expenses.
5. Travel Documentation
You are responsible for ensuring you have valid travel documents, including:
Passports valid 6+ months beyond your return date
Required visas or entry permits
Vaccine/health documentation where applicable
Names on reservations must match your passport or government-issued ID exactly.
MMV is not responsible for denied boarding or denied entry due to improper documentation.
6. TSA Requirements
TSA requires full name, date of birth, and gender for security screening.
Failure to provide accurate information may result in denied boarding.
Your ID must match your airline ticket exactly.
7. Cancellations & Changes
Cancellation fees apply per the policies listed on your invoice and those of each supplier.
Changes to travel plans may result in additional costs or penalties.
Unused travel services are non-refundable and non-transferable.
8. Baggage, Delays & Airline Responsibilities
Airlines and suppliers are responsible for flight delays, schedule changes, baggage issues, and related fees. MMV is not liable for these events.
9. Special Requests
Requests for bedding, room location, adjoining rooms, accessibility, amenities, etc., are not guaranteed and are subject to supplier availability.
10. Construction, Photos & Property Conditions
MMV is not responsible for inconveniences caused by construction, renovations, or changes in property conditions.
Photos and descriptions on websites and brochures are representational only.
11. Acts of God / Force Majeure
MMV and suppliers are not liable for losses resulting from events beyond their control, including natural disasters, weather, government actions, pandemics, strikes, or civil unrest.
12. Travel Insurance
All travel involves inherent risks. MMV strongly recommends purchasing comprehensive travel insurance, which may cover:
Trip cancellation/interruption
Medical emergencies
Emergency evacuation
Lost/delayed luggage
Missed connections
Supplier bankruptcy
I understand that Magical Moments Vacations and its advisors are not licensed insurance agents. They cannot provide advice, interpret coverage, or guarantee benefits. For all questions about policy details, exclusions, or claims, I agree to contact the insurance provider directly.

If You Decline Insurance:
You acknowledge and accept that you will not be covered for:
Medical or dental emergencies
Evacuation
Travel delays or missed connections
Family emergencies
Illness or death
Supplier default or bankruptcy
Lost luggage
Any other event normally covered by travel insurance
By declining insurance, you release MMV and your travel advisor from all financial responsibility for losses, delays, interruptions, or cancellations.
13. Liability Limitation
MMV’s liability for its own acts or omissions is limited to the amount you paid MMV for your package.
MMV is not responsible for:
Supplier acts or omissions
Personal injury or property damage
Delays, losses, or irregularities caused by third parties
You agree to release MMV from all claims related to your travel arrangements.
14. Claims
All claims must be submitted in writing within 30 days of the event. Claims submitted after 30 days will not be reviewed.
15. Dispute Resolution
Legal claims must be filed in:
Hancock County, Ohio, or
The state where your MMV advisor resides
Claims will be governed by that state’s laws. Maximum liability is limited to the amount earned by MMV or your advisor on the original booking.
16. Severability
If any part of these Terms is found invalid, the remaining provisions still apply.
Agreement to Terms
Your booking deposit or written confirmation signifies that you understand and accept these Terms & Conditions, including the Insurance Disclaimer and Liability Limitations.
